Terms & refunds

1. Agreement

These terms are an agreement between you and Shivara Studios ("we", "us"), the maker of NotePebble. They apply when you download, install, try, buy or use the NotePebble app for Windows (the "app") and when you use notepebble.com. By using the app you agree to these terms and to our Privacy policy. If you don't agree, please don't use the app.

If you use NotePebble for an organisation, you confirm that you're allowed to accept these terms for it.

2. The app

NotePebble is a sticky-notes app for Windows 10 and 11 that keeps your notes on the edge of your screen. Notes are stored only on your own PC. The app does not include cloud sync, accounts or collaboration.

3. Free trial

• You can use every feature free for 7 days from the first time you open the app on a PC.
• Each PC gets one free trial. Trying to reset, extend or get around the trial is not allowed.
• When the trial ends, your notes stay on your PC and you can still open, read, search and export them. Writing, editing, restoring backups and the dock are paused until you activate a licence key.
• No payment details are needed for the trial, and it never turns into a charge on its own.

4. Your licence

When you buy NotePebble and pay in full, we grant you a personal, non-exclusive, non-transferable, lifetime licence to install and use the app, subject to these terms.

• One-time payment: the licence does not expire and there is no subscription or renewal fee.
• One PC at a time: one licence key can be active on one Windows PC at a time. You can move it whenever you like: deactivate it in Settings → Licence on the old PC, then activate it on the new one. If you can't reach the old PC, email us and we'll free the key.
• Personal and work use: you may use NotePebble for personal, study and work purposes. Organisations need one licence for each PC NotePebble is used on.
• Lifetime means for as long as NotePebble is offered and supported. If we ever stop selling or supporting NotePebble, we will try to make sure versions you already own can keep working.

5. Activation and licence checks

To activate a key, the app needs an internet connection. The app also checks from time to time that the key is still valid. If a key is refunded, disabled, shared against these terms or deactivated, the app on that PC may become read-only. The Privacy policy explains exactly what these checks send.

6. What you may not do

• share, publish, sell, rent, lend or give away your licence key, or let others use it on their PCs
• get around, disable or interfere with the trial, licence activation or licence checks
• copy, modify, decompile, reverse engineer or create derivative works from the app, except where the law gives you a right to do so that cannot be removed by contract
• remove or change any copyright notices, or present NotePebble as your own product
• use the app for anything illegal

We may disable keys that are shared, resold, bought fraudulently or otherwise misused, without a refund.

7. Buying, prices and tax

• Orders are processed by Lemon Squeezy, our authorised reseller and merchant of record. When you buy, you also agree to the Lemon Squeezy buyer terms, and your receipt comes from Lemon Squeezy.
• Prices are shown in US dollars on our website. At checkout, Lemon Squeezy may show the price in your local currency and adds sales tax, VAT or GST where required. Your bank may charge its own currency conversion fees.
• Your licence key is emailed to the address you enter at checkout, usually within a minute or two. If it doesn't arrive, check spam, then email us.
• We may change the price of NotePebble for future buyers. A price change never affects a licence you have already bought.

8. Refunds

We want you to be happy with NotePebble. If it isn't right for you, email support@notepebble.com within 14 days of your purchase and we'll give you a full refund. No questions, no forms. Please include the email address you paid with or your order number.

• Refunds go back to the original payment method through Lemon Squeezy. It usually takes 5 to 10 working days for your bank to show them.
• Once a refund is issued, the licence key is turned off and the app returns to read-only on every PC it was used on.
• After 14 days, refunds are at our discretion, for example if the app has a problem we can't fix for you.
• This policy does not limit any refund rights you have under the consumer law of your country.

9. Microsoft Store

NotePebble is distributed as a free download through the Microsoft Store. Downloading and updating the app through the Store is also subject to Microsoft's terms. The licence to unlock the full version is sold by us through Lemon Squeezy, not by Microsoft. For questions about your licence, refunds or support, contact us, not Microsoft.

10. Updates and support

• We may release updates to fix problems, improve the app or keep it working with Windows. The Microsoft Store installs them automatically. Updates for NotePebble are included with your licence at no extra cost.
• Updates may change, add or remove features. We will not remove the core features you paid for (the dock, your notes and export) from the version you have.
• We offer support by email at support@notepebble.com, usually within one working day.

11. Your notes and backups

Your notes belong to you. They are stored only on your PC, and we have no access to them and cannot recover them. NotePebble keeps 10 days of automatic backups on your PC and lets you export your notes at any time, but you are responsible for keeping your own copies of anything important. Uninstalling the app or wiping your PC can remove your notes permanently.

12. Ownership

The app, its design, code, name and logo belong to Shivara Studios and are protected by copyright and other laws. You buy a licence to use the app, not the app itself. Windows and Microsoft Store are trademarks of Microsoft Corporation. Lemon Squeezy is a trademark of its owner. NotePebble is not made or endorsed by Microsoft.

13. Ending your licence

You can stop using NotePebble at any time by uninstalling it. Your licence ends automatically if you seriously break these terms, for example by sharing or reselling your key or getting around the licence checks. If that happens, we may disable your key. Sections 11, 12, 14, 15, 17 and 18 continue to apply after the licence ends.

14. No warranty

We work hard to make NotePebble reliable, but it is provided "as is" and "as available". As far as the law allows, we make no promises that it will be error-free, uninterrupted, compatible with every PC, or that it will never lose data, and we exclude all implied warranties such as merchantability or fitness for a particular purpose.

15. Limitation of liability

As far as the law allows, Shivara Studios will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits, business or goodwill, arising from your use of or inability to use NotePebble. Our total liability for any claim relating to NotePebble is limited to the amount you paid for your licence. Nothing in these terms limits liability that cannot be limited by law, such as for fraud.

16. Your consumer rights

If you buy as a consumer, you may have rights under the law of your country that these terms cannot take away. Nothing in these terms affects those rights. If you live in the EU or UK, you agree that the licence key is delivered right after purchase. Our 14-day full refund promise applies to you anyway.

17. Governing law and disputes

These terms are governed by the laws of India. If you have a problem, please email us first. Most issues are solved quickly that way. If a dispute can't be solved, it will be handled by the courts of India, unless the law of your country gives you the right to bring it in your local courts.

18. General

These terms, together with the Privacy policy, are the whole agreement between you and us about NotePebble. If any part is found unenforceable, the rest stays in force. If we don't enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms without our permission. We may transfer ours, for example if NotePebble is sold, as long as your rights are not reduced.

19. Changes to these terms

We may update these terms, for example when we add features or the law changes. The date at the top shows the latest version. Changes never take away a licence you have already bought. If you keep using NotePebble after a change, the new terms apply.
